JACKSON COUNTY, IL (KFVS) -

The new attorney for a man convicted in the death of an SIU student in is speaking out.

The new attorney, Steven Greenberg, said he believes the judge will be compelled to vacate the jury's verdict.

"I don't believe the law supports his verdict," Greenberg said.

He said he will file a post trial motion before the new sentencing date.

Gaege Bethune got new legal representation just days before the original sentencing date.

The Associated Press reported that Bethune's new defense attorney won a delay in sentencing as he aimed to have the conviction thrown out. A judge pushed the sentencing back to Sept. 17.

According to online documents, the Jackson County Circuit Court granted Bethune's attorney Mike Wepseic's motion to withdraw as part of his case.

Steven Greenberg and T. Liam Kelly will now serve part of Bethune's counsel.

The online court documents also noted that the defense filed a motion asking for an extension of time to prepare and file an additional post-trial motion.

The judge denied the motion on new trial for Bethune one day after his 24th birthday.

Bethune was found guilty on Thursday, June 14 of first-degree murder predicated on aggravated battery in the death of Pravin Varughese.

He faces anywhere from 20 to 60 years in prison.
