MO man, woman accused of forcible rape, child porn possession

BENTON, MO (KFVS) -

A grand jury indictment was issued for a Benton, Missouri man and woman charging them with forcible rape and child pornography.

Clayton D. Counts, 67, was charged with 15 felony charges, including seven counts of first degree statutory rape, three counts of forcible rape, three counts of forcible sodomy, possession of child porn and unlawful use of a weapon.

Judith E. Gray, 58, was charged with seven felony charges, including three counts of forcible rape, three counts of forcible sodomy and possession of child pornography.

According to Scott County Sheriff Rick Walter, these new charges are due to an ongoing investigation.

On Tuesday, January 26, Scott County deputies and officers with Alcohol, Tobacco and Firearms served a search warrant at Counts' home.

The search warrant was part of an ongoing investigation into a child molestation case.

During the search, deputies say they found an inappropriate picture of a girl younger than 18 years old in the bedroom of Counts and Gray.

The victim allegedly told investigators that Counts had taken the picture of her.

Officers also found a spent shell casing inside a drawer in the bedroom, along with ammunition and a shotgun inside a vehicle outside the home.

Counts is a convicted felon for a murder in 1988, along with other felony convictions, so he cannot possess a firearm.

According to the sheriff's department, Gray was allegedly present during incidents when Counts was allegedly raping the victim. Gray would allegedly hold the door shut in order to keep anyone from going inside the bedroom during the alleged rape.

Counts is still in custody on prior charges of child porn possession and unlawful possession of a firearm. He remains in custody in the Scott County Jail on a $100,000 cash only bond.

Gray was released from custody on a prior charge of child porn possession, with a summons to appear in court, but was found and arrested on Tuesday, Feb. 23 at her home. Her bond was set at $50,000 cash or surety.
