Police in Bernie, Missouri arrested a man accused of burglary and domestic assault.

Chad D. Rushin is facing charges of first degree burglary and domestic assault second.

According to the probable cause statement, a police officer was dispatched to a home on Mann Street in Bernie on Sept. 20 at 8 a.m. in reference to a call from a man stating his daughter had been attacked by her ex-boyfriend.

Police say the woman told them she was in the bathroom and when she walked out, Rushin allegedly came up from behind her and put a cell phone charging chord around her neck and started choking her.

The woman said she started walking toward the front door, grabbed a small metal pick and tried to stab Rushin as he was still choking her. She said when she got to the front door, she was able to pull away from Rushin and then ran to her father's house.

According to the woman, she was not sure how Rushin had gotten into the home. She said Rushin had not been living with her.

While inspecting the front door of the home, the officer said he noticed tool marks on the outside trim, as well as tool marks on the inside latch of the door knob. The officer said the striker plate on the front door was broken loose from the bottom.

The officers said he knocked on the front door of the home and there was no answer. He said he opened the door and saw a man, later identified as Rushin, sitting in a chair just inside the doorway of the living area. He said he also noticed a baseball bat lying next to him in the chair.

The officer asked Rushin to step outside. He said Rushin told him he had been arguing with his girlfriend.

Rushin allegedly told the officer he had been scratched under his right eye and that the woman had tried to stab him with an ice pick.

According to court documents, the officer photographed a red mark on the woman consistent with her having been choked. The officer also photographed and collected the cell phone charging chord for evidence.

The officer said the pick was found later and dropped off at the police department.

Court documents state that it was later learned that Rushin is a noncompliant sex offender. The officer noted that the woman's house on Mann Street was across the street from a daycare facility on W. Fordyce Ave.
