Alleged 7-year-old victim testifies against Cape Girardeau Co. 'Santa Claus'

JACKSON, MO (KFVS) -

A man who played Santa Claus in Cape Girardeau County was in court Tuesday on a statutory sodomy charge.

Jeffrey Moffat, who has played the role of Santa Claus at Iron Mountain Railway, was in court Tuesday for a preliminary hearing. 

Moffat, 55, faced two charges going into court on Tuesday. The court dismissed the charge of first degree statutory rape due to insufficient evidence. Moffat still faces a first degree statutory sodomy charge. 

According to the probable cause, Moffat is accused of touching a young girl on more than one occasion. He denied touching the child in a sexual manner, but said at the conclusion of the police interview that "Children don't lie."

Moffat was walked over from the Cape Girardeau County Jail to the courthouse. He was wearing an orange jumpsuit, handcuffed and shackled. 

Moffat was in the courtroom when the alleged 7-year-old victim walked in.

Assistant Prosecutor Julia Koester and Defense Attorney Amanda Altman cross-examined the young girl. 

Koester first asked the girl if she knows the difference between the truth and a lie. The girl replied, "yes."

Koester then asked a series of questions of the girl referring to two pictures of a male and female body. Koester asked the girl if she knows a difference
between a good touch and a bad touch. The girl replied "yes" again. Koester then asked her if anyone ever touched her in a bad way. The young victim said, "Yes. It was Jeff."

The girl said that Moffat babysat her and her siblings at her home and at his home at times. 

Moffat looked down and held his hands together most of the time while the girl was questioned. 

Defense Attorney Amanda Alton asked the girl who she first told about this and why.

"Nanny. I was so scared so I told her. I remember it all the time," said the girl. "He did something bad to me like kiss me and stuff."

The young girl rocked side to side in her chair and answered every question she was asked. She also said she was going to counseling. 

The mother of the victim testified as well. She said Moffat was a family friend and had no prior problems with him. The mother also said the sexual abuse started in August 2014. 

Moffat is still behind bars and faces a cash only bond of $50,000. 

Iron Mountain Railway President Cheryl Huffman says she believes Moffat is innocent.

This story had a lot of of people commenting on Facebook, many who were "outraged" by the news. 

One person says the story makes her stomach hurt. 

Another wrote, "Knowing my son has sat on his lap the past two years makes me so sick to my stomach."

Moffat is due back in court on Aug. 24 at noon in front of Judge Benjamin Lewis.
