Former probation officer facing misconduct charges

KENTUCKY (KFVS) -

A former probation officer is facing charges after a Kentucky State Police investigation.

Robert "Bobby" Johnston, 40, of Benton, Ky., was charged with tampering with physical evidence, second degree forgery and first degree official misconduct.

A criminal summons was served on Johnston on Monday, April 20.

In December 2014, KSP was contacted by the Department of Corrections about a probation and parole officer allegedly engaging in misconduct, related to a parolee and the administration of a field drug test to the parolee.

DOC asked KSP to pursue a criminal investigation into the alleged misconduct.

In February 2015, a detective began investigating with Johnston that occurred on Dec. 2, 2014. During the investigation, police say it was discovered that Officer Johnston allegedly inaccurately reported the results of a field drug test on a parolee he was investigating in Marshall County.

On April 16 the detective testified before a Marshall County Grand Jury about his investigation.

The grand jury returned indictments for the charges and the summons was issued.

Police say the investigation is ongoing. KSP was assisted by the Kentucky Department of Correction's Internal Affairs Branch.
