CAPE GIRARDEAU, MO (KFVS) -

A man was taken into custody after police say he fired a gun during a domestic dispute. It happened at Cape Meadows Apartments.

Court papers show James Calvin Sims, 29, of Cape Girardeau, Missouri is facing domestic assault, domestic second degree, unlawful use of a weapon charges.

The Cape Girardeau Police Department responded to the disturbance at 516 Cape Meadows on Wednesday at shortly after 3 a.m.

Officers spoke with the victim who said that her husband, Sims, was upset because a male friend of hers had come by the apartment wanting to speak to her.

Police say Sims had grabbed a gun and confronted the other male subject outside the apartment.

Police say during the confrontation, the husband fired a round off onto the ground of the parking lot.

It is believed that the bullet ricocheted then grazed the hood of a car in the parking lot.

Police say when the gunshot was fired, the other male ran off and Sims ordered his wife back into the apartment.

Once inside, police say Sims was accused of assaulting his wife by hitting her in the head several times with the gun.

Officers did see injuries consistent with this on the wife's head, but she refused any medical treatment.

The gun that is believed to have been used in this incident was recovered from a dumpster near the apartment building.

The other male was located and spoke to officers. He did not have any injuries.

Sims was taken to the Cape Girardeau City Jail.
