Illinois Lawmakers Sue Governor Over Stalled Paychecks

The decision to stall Illinois legislators pay placed Governor Quinn in front of a Cook County judge Wednesday, after house speaker Michael Madigan and Senate President John Cullerton decided to sue him.

It was a move Quinn acted on to help deal with Illinois' nearly $100 billion public pension problem but legislators are calling it unconstitutional.

Quinn says he has the authority to veto the salaries and if lawmakers want to see their paychecks they can return to Springfield and vote to override his veto.

Quinn used his line item veto earlier this summer to cut money for legislators' salaries from the state budget and for the last two months, lawmakers haven't seen a single paycheck.

Lawmakers failed to reach an agreement on how to deal with the pension problem during the legislative session that ended in may.

One downstate legislator why don't they just return to Springfield and vote to veto Quinn's decision.

"Every time that they don't agree with what the legislator does then they would veto their salary and it would be a set precedent," say Representative Mike Bost. "This time we want to make the ruling so that it is in the clear message to any governor in the future that this is not the way."

After hearing arguments from both sides Wednesday the judge says he will rule next week on a lawsuit over the governor's decision.

Representative Bost told me he himself has not been affected much, yet but his stalled payments but says some legislators are facing bankruptcy if they aren't paid soon.
