Alderman candidate plans protest election in Marston after complaint

MARSTON, MO (KFVS) -

On Election Day, did one Missouri election judge go too far? That's the question being asked in Marston, in New Madrid County.

It allegedly involves a voter who can't read or write, and an election judge who, witnesses say, filled out his ballot for him.

County Clerk Clement Cravens confirmed a compliant has been filed involving an election judge. Craven said Tuesday night that an investigation was going to take place once the election is over.

Alderman candidate Joe Ross, who lost his bid Tuesday night, says he plans to protest the election because of that accusation. Ross, or any candidate, has 30 days to file a protest.

The election judge was removed from the polling place on Tuesday. 

Witnesses say an older man who can't read or write walked in with a family member to vote.

They say the election judge insisted on helping the disabled man fill out his ballot.

The nephew of the disabled voter says he doesn't understand why he wasn't allowed to help his uncle fill out his ballot.

The fear is the man who can't read didn't get a say in his vote.

"Because he didn't mark nothing," said Michael Moering, the man's nephew. "The lady didn't even read the names to him who all really was running."

Heartland News looked into the role of election judges and if a family member could assist in the process.

According to Missouri statutes, if any voter declares under oath to the election judges that he cannot read or write, he may be assisted by the election judges or by any person of his own choice other than a judge.

Cravens says he can't comment on the complaint specifically right now.

He says there are so many variables and this may not even be what he calls a "viable complaint."
