No criminal charges to be filed in connection to July stabbing death

CAPE GIRARDEAU COUNTY, MO (KFVS) -

No criminal charges will be filed in connection to a July stabbing death in Cape Girardeau County. That's according to a letter to the sheriff's office Friday from Prosecuting Attorney Morley Swingle.

Swingle says no criminal charges will be filed in the stabbing death of Walter Scott Claar because the actions of the stabber were justified under Missouri's "Castle Law."

In the letter Swingle says under the law, "a person may use deadly force against someone who is committing a forcible felony."

The incident happened on the morning of July 3, 2011 on Old Route V, just outside of Cape Girardeau.

Police say the disturbance resulted in Claar receiving stab wounds from a knife.

Claar was originally taken by ambulance to a local hospital where he underwent emergency surgery. Claar died from his injuries on July 7.
