CAPE GIRARDEAU, MO (KFVS) -

A judge's order Monday morning requires Commander Premier Aircraft Corporation to vacate a hangar at the Cape Girardeau Regional Airport immediately.

"That was what we had asked for, that was the subject of the petition", City Attorney Eric Cunningham said of the judge's order.

If the company is not out in 10 days, city attorney Eric Cunningham says they have the authority to physically remove them.

"We're having to work on a plan for how we would get all of that equipment and inventory out of the building because there's quite a bit in it", Cunningham says.  He also points out no on from Commander appeared in court to hear the judge's ruling.

According to the court documents, Commander owed the city of Cape $827,283.39 as of May 16, 2011.  The monthly rental payment under the sublease was $21, 016.67.

The last payment was made in December 2007.

Cape Girardeau terminated the sublease on May 16.

Commander, based in Tyler, Texas, filed for bankruptcy protection on June 16.

In August, a Texas judge ruled in the city's favor during a bankruptcy hearing.

Cape Girardeau City Manager Scott Meyer has said ultimately the city wants to free the hangar space so they can lease it to another company.
