    According to a new affidavit released Monday, Clay Waller's father says Clay went to him a few days after his estranged wife's disappearance and confessed to killing her.  According to court documents, Clay told his dad the hole was already dug and he buried her with a shovel.
CAPE GIRARDEAU, MO (KFVS) -

Clay Waller's federal defense attorney says there is nothing to show his client is either a danger to the community or a flight risk.

Scott Tilsen included these points in an motion filed Monday afternoon to revoke the detention order keeping Waller behind bars.

Last week, a federal judge ruled Waller should be kept in custody until he goes to trial on a federal indictment charging him with writing an internet threat directed against his sister-in-law who has custody of his three small children.

Tilsen argues Waller has strong ties to the community, no criminal history, and denies responsibility for the disappearance of his estranged wife Jacque.  Jacque Waller has been missing since June 1.

No word yet on if Tilsen's motion will be argued in court.
