Trial in Cape Girardeau murder case to begin

CAPE GIRARDEAU, MO (KFVS) -

An Illinois man charged in a Cape Girardeau murder goes on trial Wednesday.

It goes back to July of 2010 when 44-year-old Matthew Ervin was found shot to death in the Middle of Fountain Street.

Police say Ervin was shot at close range by Thomas D. Evans Jr. of Bellwood, Illinois.

Ervin's car was located near the crime scene. While searching for clues inside the car, police say they found a key to an apartment at 418 Themis.

After confronting Evans, police brought him in for questioning. They also collected evidence at the apartment complex which included a pair of blood-stained tennis shoes, socks and a shirt.

While being questioned at the police station, Evans admitted to shooting Ervin.

An investigator says Evans claimed Ervin made threats and appeared to be getting a gun from his vehicle when Evans fired two shots out of self-defense.

Jury selection is to get underway Wednesday morning in Butler County where the trial will be held on a change of venue.

Cape Girardeau County Prosecuting Attorney Morley Swingle says opening statements will be delivered early in the afternoon.
