CAPE GIRARDEAU, MO (KFVS) - Clay Waller appeared in federal court Thursday morning in Cape Girardeau for a detention hearing on a federal charge of Internet threatening.

During this proceeding, Judge Lewis Blanton informed the court that Clay Waller has been indicted by a grand jury on charges that have yet to be revealed.

Waller pleaded not guilty to those charges.

Ferrell requested the court move to a long term care facility in Cape Girardeau so that James Waller, Clay's father, could testify.

US Assistant Attorney Larry Ferrell said Clay Waller confessed to his father that he killed his wife, and buried her in a hole.

The court denied the request to move the hearing to the nursing home, but the judge granted the request for a deposition.

Ferrell submitted new information on the disappearance of Jacque Waller. The US Assistant Attorney worked to argue to the court that Waller is a dangerous man and should be held without bond.

According to the affidavit, blood spatter was found in the defendant's home on two walls.  Police also found several pieces of cut up carpet and carpet pad from a crawl space in the basement. that were hidden out of view.  The Missouri State Highway Patrol Crime Lab reported the blood on the two walls and blood of a piece of carpet contained Jacque Waller's DNA.

Waller told police Jacque had an accident in the kitchen which caused her face to bleed.  According to the affidavit, Clay said, "she started bleeding like a....lot."  He said she started to run to the bathroom, but tripped in the hallway and fell, according to the affidavit.

Waller told police he did not tell police about the blood in the house and on the carpet because "it was no big deal."

In Jacque's diary, there are several claims of Clay threatening her and her children's lives.

Waller is also charged with threatening his missing wife's sister on the gossip site Topix.

According to court papers, Waller is accused of posting a message that reads in part, "You are dead...Your dad threaten(ed) clay, I know he's all talk, I will get you 5, 10, 25 years from now. You have it coming."

The user name was identified as "Cherl."

Heartland News obtained court records of the actual complaint filed against Clay Waller on Monday.  According to the affidavit, Cheryl Brenneke, Jacque's sister, who has custody of Jacque and Clay Waller's three children, feared for her life and contacted authorities.

According to court papers, police traced the I.P. address back to an account associated with Plaza Pawn in Cape Girardeau.

The store manager told investigators Clay Waller walked into the store on July 26 around 10 a.m.  Managers say he asked to use the computer in the business office so he could use the Internet.

Managers told authorities the computer was checked and they noted Waller had been on Topix and other sites. The store manager says he was the only one to use the computer. Surveillance later confirmed Waller was in the store.

Waller is the estranged husband of Jacque Waller, missing since June.

On charges unrelated to that case, Waller was in the Cape Girardeau County Jail facing fraud and harassment charges. Waller posted bond at the Cape Girardeau County Jail Friday, and then was immediately taken into federal custody.
