Orient, IL- Franklin County State's Attorney Tom Dinn filed attempted murder charges against an Orient man Tuesday. 45-year-old Timothy Litton was charged with five counts of attempted murder, four counts of aggravated battery with a firearm, and two counts of aggravated discharge of a firearm.

"I don't think it was a shoot out like the O.K. Corral, but the officers showed restraint or otherwise we could have had a more serious ending for this,” said Benton Police Chief Mike O’Neill.

Police say the Christmas Day shoot out at this orient home could easily have turned deadly; either for the suspect, or one of the 19 officers responding to the call.

"They were technically under fire, and it's just a serious situation," said Sheriff Bill Wilson.

Illinois State Police investigators say the first officer on scene, Trooper Paul Moak, had a very close call when Litton allegedly shot out the car window.

"If the trooper had taken the round that came through that window, it would have been a much worse story today,” said Master Sergeant Stanton Diggs.

The bird shot sprayed the driver's side of the car leaving small chips in the paint, but Trooper Moak wasn't hit. Four other officers: Deputy Todd McDickens, Officer Chris Funkhouser, Officer George Bechelli, and Officer Ray Blades sustained minor injuries due to being hit by twelve-gauge bird shot. All four officers were treated and are back to work. Litton was also treated for a bullet wound to his knee. Litton remains in custody at the Franklin County Jail on $1 million bond.
